"I can't drive one twenty five."
I have driven a Harley at 120 mph. I was lucky I wasn't killed, which is the title of the story of my life now in paperback writer.

Sell it and give him the money. But civil forfeiture of an $11K+ bike is theft

This guy is lucky to be alive. Like man tom, I have ridden many miles on two wheels, starting when I could drive a Cushman scooter below 5 hp in Colorado. I have always ridden like I was invisible to drivers of cars and trucks. Taking this dude's motorcycle isn't fair, but it will likely save his life. When I became a private pilot, the instructors last bit of advice was: "There are bold pilots and old pilots. There are no old, bold, pilots."
The same philosophy applies to motorcycles.

The correct legal punishment for this is:
"Throw away the key."
